VOD TERM & CONDITIONS OF USE

By using this video-on-demand (VOD) service, you declare that you have read and agreed to these terms and conditions of use.
- The following terms and conditions of use are the exclusive contractual conditions between OMnet, Inc. and the user of this service.
- To watch films the computer system and internet connection must meet certain minimum requirements. There are free test films available to ascertain the minimum requirements are met.
- This service is based on single transactions. There are no automatic or recurring charges. It's not a subscription based service.
- Bought films or credit cannot be refunded.
- The user guarantees that all information provided about himself is true and complete. The user particularly guarantees that he is at least 18 years old.
- User data is not passed on to third parties. All data is strictly confidential and as a matter of course is not stored on the web-server.
- This service is aimed at adults. All access data (username/password) is private and confidential and may not be passed on to any third party, explicitly not to minors.
- The films on offer have been licensed by the site operator for private use. Distribution, altering or public performance is prohibited and can be legally prosecuted.
- The creditcards are discreetly charged by OMNET AG.
- Using the VOD-Download service the films are after purchasing downloaded and stored by the user to his computer system using an internet connection. The user has the right to play the film on this system within the mentionned period of time without restrictions. Certain films must be activated over the internet before they can be played the first time, this either happens automatically or manually by entering an activation code. The technical possibility to download a film file and to activate it, is warranted during 60 days after purchase.
- With VOD-Streaming the film-data is streamed and displayed directly on the computer screen. The user must be aware that, due to the technical facts of the internet, a constant film-quality can only be achieved if the necessary bandwidth exists between our server and the user's device. Shortcomings of bandwidth on the internet are rare, but are essentially outside of our influence wherefore we cannot accept any responsibility or liability.
- To minimalize the risk of fraud, we reserve the right to not immediately activate purchased films and to demand further information to verify the credit card details. If there is any cause for suspicion we can, and explicitly reserve the right to do so, temporarily block an account pending further investigation.
- A VOD film consists of the main part of a film. Possible bonus material that could be on a DVD are not available for download/streaming.
- By means of our test films the user can check if playback works fine at any time at no cost. Any warranty or liability in this context is - as far as legally permissible - waived. Any refund-claims are therefore excluded.
- Aside from the technical facts of the internet we cannot guarantee one hundred percent availability of this service although we make every effort to keep the service available at any time. - ORGAZMIK sends out a newsletter once a month only. At the time of registration the user is asked whether he wishes to receive such a newsletter. It is possible to unsubscribe from this at any time.
- New accounts will be deleted within one week if no first login or transaction was made during that time.
- This contract is subject to Swiss law. Place of jurisdiction is Zürich, Switzerland.
